  • J1 visa extension clarification

    Hello,
    I need a clarification for J1 extension. I'm in USA now and My J1 visa is going to expire on 31st July 2018 with 12 months as a trainee category. I have been in USA two years back with the same type (J1) of visa during from May to July mid 2015. I have completed the two years home residency requirement. After that I got the another chance for coming to USA with J1 visa for 12 months on from Aug 2017. So Now I'm USA.
    My question is there any possibilities/way to get an extension for another one year with another (new) J1 program or with the existing J1 visa.
    Also I need a clarification for the two year home stay requirement, as I have already completed 2 years home residency requirement for my previous J1 visa, is it mandatory to complete another two year home residency requirement for the current J1 program ?

    US "visas" are only for entry to the US. The visa's expiration date is just the last day on which you can use the visa to enter the US; it has no relevance to your stay in the US. J1 are usually admitted for "D/S" on their I-94s, meaning they can stay indefinitely as long as they have a valid DS-2019 and follow the rules of J1 status. You can transfer to another J1 program in the US. That does not require anything to do with the visa. Only if you leave the US and want to re-enter do you need a visa.

    If the new J1 program has a 2-year home residency requirement (not all J1 do), then you will need to be physically present in your home country for 2 years again after this program before you can get H or L work visas or permanent residency.
