As i posted in your previous post: You will need a waiver for the J1 physical home country requirement.

    Here are you instructions:

    http://travel.state.gov/visa/temp/info/info_1288.html

and some of the forms you will need + additional info:

    http://travel.state.gov/visa/temp/info/info_1296.html

    ----

I think you could use either a "No Objection Statement" or "Hardship to USC" reasons.

    ---------------

You will face questioning and a hard time proving your marriage, since you have not been living together and have been in different countries on and off. Also, it was NOT a good idea to "lie" on your J1 visa application, it will come back to hunt you.

        that married and single thing...
is it very impportant? Yes. and will they actually care about it that much? Yes. You lied in order to obtain immigration benefits (namely your J1 visa).

sure i am planning to apply for the J1 but i am worried about this marriage thing............the fact my first visa had me as a 'single'...i know it was stupid of me to have done that....but to intent to deceive anyone Lying is another word for deceiving. You should not have lied.

btw we have a daughter who is 10 month old now...is it still difficult to prove the wedding... It will be difficult to prove the relationship/marriage. Not that the wedding took place. You must have evidence of a life together, joint ownership, insurances, etc.

        many thanks for your advice
