  • J1 visa question

    I am medical student who got his MBBS degree from India. I first came to the US on a student visa back in 2004 to pursue graduate studies. While I was pursuing my graduate degree I got to married in India in Feb of 2009. My wife is a green card holder. However, she is not eligible for citizenship yet, as she could not meet the continuous presence clause. She is currently living in India for educational purpose.
    I also have two siblings, a brother and sister, who are currently in the US on H1-b and F1 visa respectively.
    Now, I have obtained a spot to pursue residency clinical training in the US. The hospital is sponsoring J-1 visa for me. I am in India right now, will be applying for J-1 visa stamping in the next couple of weeks.
    Here are my questions that I need help with.
    1. When applying J-1 visa, should I mention in the application that I am married to a person who is an immigrant? Because, I am worried that the consular officer will see me as a potential immigrant who is applying for non-immigrant J1 visa. I am not planning on using my wife’s immigration status to apply green card anytime soon. In fact, I will have to come back to India for 2 years after training since I have accepted J1 visa.

    2. When I applied for student visa in May of 2004, my friends told me that my F-1 visa application could be rejected on the basis that I already have brother who was in US at that time on F1. I mentioned in DS-156,157, 158 (on one of these forms) at that time that I have only one sibling and that she was married. I gave one of my cousin’s name in that application instead of my brother’s and sister’s.

    Now, that I am applying for J-1 non-immigrant visa, I wish to set the record straight by giving true information in the application. But I am afraid that, they will correlate the information from my previous application in 2004 and find out the inconsistency. Could you please advise me on this matter as what to say and what not to say in my J-1 application?

      u must tell the truth if you get caught lying you will be denied any future visa applications
