  • Tricky J-waiver Question

    Hi,

First of all, thanks for this forum. I have a few tricky questions and I hope someone here can provide me with some advice/answer.

I am on J-1 visa (Research Scholar) and have a 12 months contract signed last month. My professor is planning to move to a university in 3 months time but I am not keen to go with him to that University. While my wife is currently on F1 visa as she just started her PhD study. She transfered her visa from J2 to F1 in June.

I am planning to apply for J-waiver so that I can transfer to F-2 visa while looking for an H1B job. I am worry that three months is not enough for me to obtain my waiver.

    Here are my questions:
    1. Can I apply for my J-visa waiver through No Objection Statement now and then leave USA when I quit my job (in 3 months) and return to my home country.
    2. Will my application for J-waiver still valid while I am not in the country? Do I need to be "physically present" in USA until I receive the waiver?
    3. If I obtained my waiver, is that true that I can not apply for another No Objection Statement-NOS if I have another J visa job in future?

    Please Help me.....

    God bless you
