My girlfriend, who is from Russia, is facing limited options as her current living situation isn't suitable. She cannot stay with her family and finding another host family is challenging due to restrictions from the agency. They allow only one rematch per au pair, and her previous host family opted for a cheaper alternative from a different agency. In light of these circumstances, I have a question: Is it possible for owespeedtest my girlfriend to change her visa status from J1 to a tourist visa while she is already in the United States? Yes, since au-pairs are not subject to the INA 212(e) 2-year home residency requirement, she can file I-539 for Change of Status to B2 status.
