I have a couple of question I would like help with. Just a little background on my situation, I'm a US citizen and my fiance is a Nigerian national, I am older then he is by a few! years, we have been together for almost 4 years. He is currently in Finland on a student visa where he will be attending school for the next 3 yrs, he has been there for 5 months already. I myself just got back from a month long visit with him, this was the first time we physically met. I am planning on going back there in late June or early July for us to marry, we decided to go the route of the I-130 vs the K-1 since he will still need to attend school.
As mentioned we feel the the I-130 would be the best route, when I go back, June and we marry I will come back and process the necessary forms. Since he will be in school for the next 3 yrs which will be more then enough time to process the application. But here are my questions;
1. While the I-130 is being processed can we apply for a visitors visa for him to come visit me in Dec during his school winter break. (he applied for one 3 yrs ago and was denied because of no travel experience which he has now and he is from Nigeria)
2. When the I-130 is approved will he be allowed to come and go to the US during his school vacation breaks until he is finished with school and then come live with me in the US permanently.
3. Because of our age difference and him being black and I'm white will we have to show all the evidence of our relationship as suggested for the K-1 be necessary (because we have plenty of our relationship)
