  • Police Clearance for K-1 Visa?

    Hello

    I'm filing for I-129F for my fiance. Does she need a police clearance even if she's free from any incidents/law/felony?

    She has lived in New York for last 10 years but recently went back to Korea. How does she obtain a police clearance from NY when she's in Korea? Do I need this to file for I-129F? If not, when do I need this form?!?

    You don't need the police clearance when submitting the K1 petition (I-129F). But she will need clearances from Korea and any other country she has spent at least 6 months in since turning age 16. Some countries are excepted, as their clearances are not considered reliable: Mexico, Afghanistan, for example.

    The U.S. Embassy in Korea might not expect her to provide a U.S. police clearance, or they may do a name check for her through the FBI.
