    Hi, I am an American who moved to Italy and married an Italian in Italy. I have lived here for 5 years and now want to go home. We are starting to prepare all the paperwork needed but we are a little confused about the support paperwork. I have not worked in the past 5 years so I have no tax returns to show them. I have no family in the states that can be his sponsor. He has assets here. He has a building in Venice that he rents out and has income each month. Is there a form we could use to verify his assets so he wouldnt need a sponsor?

    Even though you have no income, you are still the primary sponsor and will have to submit an I-864, with an explanation for not having income to sponsor your husband. Your sponsorship documents are not submitted until after the petition is approved, either by USCIS stateside, or by Direct Consular Submittal (DCF), if a DCF is accepted by the U.S. Consulate serving your area of Italy.

    For your husband's assets and income, foreign-based, to be accepted for U.S. sponsorship,there must be significant documentation of ongoing income or of available liquid assets. Your husband's sponsorship will have to be documented with form I-864A, "as the household member." Getting your husband's income source accepted as meeting sponsorship requirements may be your biggest hurdle. I've never seen it being accomplished unless there was proof of available cash, in the bank, of at least 5 times the sponsorship income requirement.
