  • US citizen filed i 130 need help

    I filed an i 130 back in march 2014. I was told that it should be processed in 5 months or less. Now it is August and it still has not been processed. I sent in everything needed plus proof with documentation with the original application. In these 5 months they have not sent by me anything stating that I needed to send them any information at all and my husband has not received a letter for his interview yet. What should I do at this point? How much longer should it take? Can I file something to get him here in addition to what I have already filed.

    You should have received a text/email confirmation of USCIS receipt of your I-130 within two weeks of submittal, IF YOU INCLUDED FORM G-1145 WITH YOUR SUBMITTAL.

    Following that, you should have receivde a Receipt Notice of Action, form I-797. Did you receive that?

    The approval I-130 could take 5-12 months (less time if you are a U.S. citizen) after which it goes to the National Visa Center for payment of fees and submittal of sponsorship and civil documents.

    Did you receive USCIS acknowledgement of receipt of your I-130 soon after its submittal?

      I receivef the form with the receipt number on it stating that the received my froms on the 6th of March. The letter also stated that no other information was needed. They didnt just get the i130 application from me but they also received the affidavid of support, the request for email notification and all supporting documents. So yes I did receive the i_797 and I did submit the G -1145. August 6, 2014 made 5 months from the day everything was received.

        There was no need to include the Affidavit of Support, as you will need to submit that form and supporting documents to the National Visa Center, if your husband is being processed outside the U.S.

        You're not that far away from normal approval for an I-130, after which it goes to the National Visa Center for a few more weeks of fee and paperwork exchanges.

          Im in Texas and I processed everything here but my husband is in Jamaica. I also sent in my payment along with the application.

          I was hoping he would be here before the end of August because i am having complications with my lung from a previous surgery.

            I suspect that you haven't been given or read an overview of the standard immigrant paperwork process.

            If your spouse is being processed outside the U.S., the sequence is as follows:

            1. You submit I-130 with $420 fee to USCIS.
            2. After USCIS approval of your I-130, you pay $88 (sponsorship processing) and $230 (immigrant visa fee) to the National Visa Center, then submit I-864 and Civil Documents (certified versions) to the NVC.
            3. After NVC approval, your husband completes immigrant medical exam ($200 - $300, depending on country), and has Embassy interview.
            4. After visa is issued, you pay $165 for Green Card issuance.

              I only knew of the $420 fee and the fee for the medical exam. What is the civic documents and the i 864.

                After your I-130 petition is approved, it goes to the National Visa Center, and you then have to pay two fees, $88 and $230. You then have to submit the I-864 and supporting documents for sponsorship, and civil documents (certified birth, marriage, passport-style photos, copy of appolicant's passport ID page).

                  Ok, I understand you know, see I was told to include all that information with the i 130 application. The only thing I didn't include was the $88 and the $230 fee but I also included the form i 864 and all related documents.

                  The birth certificates, marriage license, passport photos, passport id page was received with the I 130 application.

                    The initial submittal of the I-130 petition to USCIS was not supposed to include the $88 and $230 fees, nor the I-864.

                    After the I-130 petition is approved, it goes to the National Visa Center, a second step, and you will then pay the $88 and $230 fees, submit the I-864 and cibil documents.

                    When you submitted the civil documents with your I-130, you were supposed to submit copies (photocopies). But when submitting civil documents to the National Visa Center (NVC), you must submit certified versions of the civil documents.

                    You say you were told about these requirements, but you were not informed about the correct sequence of the requriements.
