    Hello,

    My name is Noreen, I am widow and 57 years old. I came to US on fiance visa but can't marry to a person who sponsored me to bring here. The main reason is I don't want to go back to my homeland because my son and daughter both are living here.

    What are the pros and cons if I stay and what different ways I can follow?

    1. There is any way by which I can get residency if I stay on my fiance visa?

    2. Does my children's be effected? Because I came on my own and still they haven't filed any immigration for me?

    3. There will be any problem for a person who helped me to come US?

    4. Any other thing which we are not considering?

    5. Any benefit if I stay here because once I leave US then hardly I will get another visa.

    Son / Daughters / Friends I am really seeking for genuine help.

    Once here on a K1 visa, your status cannot be converted to Permanent Resident by anyone other than the K1 petitioner. Your best option would be to return to your country and be petitioned by one of your children, if a U.S. citizen.

      Dear Mr. Ray B,

      Thank you for your reply. My children's are resident (green card holder). I am enjoying good time with my family and grandchildren's here. But I admit your sincere suggestion.

      I have one more question related to this like if I over stay here and live with my family up to 5-10 years so still there will be no any chance to get residency in the future? I am 57 years old so won't they give me soft corner as old age person.

      I am not sure but here some relatives and my daughter said lawyers may help. But here on this site peoples are genuine and not greedy for money. So we are more focusing from suggestions on this site compare to lawyers.

          Your K1 visa cannot be converted to any other status by any other person than the original petitioner who brought you here. In order t stay here legally, you must return to your country and be petitioned by a relative. But since you will have become a visa overstay once your 90-day K1 visa period ends, and you do not marry the person who petitioned you, you risk being barred from reentry if you leave the U.S. and try to return in the future.

          You're probably better off just staying here until some other conversion option becomes available to you in the future.
