  • I-134 poverty threshold guidelines

Hi! Me and my Fiance are in the process of the K1, Visa, but I am really stuck on a issue which I can't seem to find an answer for anywhere.

I am self employed. I am going to report about 21-23,000 income, which exceeds the 125% poverty threshold guidelines even for 2 people. My concern is, that I am self-employed, and I need to make a lot of deductions (mileage, etc). Is this going to be an issue with my income? When the embassy is examining it to see if I fall into poverty, will they look at the income before or after tax deductions?

I would appreciate any advice or suggestions about this or even a start of where to even find this out because I'm pretty lost right now :/

For self-employed filers, your net business income (total income on line 22 of form 1040) is what the Embassy looks at. The problem with self-employed income is that your final total income can be much below the sponsorship requirement, even though you had significantly more income available to you for personal use.

You must provide evidence that a "below required income amount" on line 22 of your form 1040 is based on bookkeeping deductions (depreciation, etc.) and income available for personal use greatly exceeds the required sponsorship amount. This can be shown by bank statements showing cash flow, invoices from clients, etc., and a succinct and credble explanation for why your form 1040 doesn't accurately reflect a true amount of monies available to you for personal use.
