can you file while in the USA

JUst wondering if anybody knows if we can file for a fiance visa while i am visiting in the usa????

I was in the same boat

I have a brazillian gf and she was here on a visitor visa. we decided to have her go back to brazil, apply for k1, and then have her in brazil to handle the consulate inquiry there.

I asked a few times here, some people said go ahead and get married here, but that didnt seem like the best/fastest path. she becomes an 'immediate family member' once married and we'd have to go through the spousal process. Getting married here would violate her visitor's visa and I dunno if immigration would frown on that..

We're worried the K1 process time might take a while, but we figure we're playing by the rules and hopefully that'll count towards something when the immigration people look at it. everyone says the k1 one is quickest and most painless..

maybe you can get do the other path, marry your girl in the usa and see what happens?

Not really man..,the new law IMBRA affatecting every immigrant visas...K1 is non immigrant but this handle like an immigrant cos the purpose is marriage with US citizen and relocation to usa...so this new immigration law causing a delays in every visa...so be prepared for a wait...but i hope things work out for u guys..,
