    Hi all,

    I'm so confused lately for hearing some people say that fiancee visa is tougher and longer now....spouse visa is more secure and faster now...
    I'm trying to get my girl friend over from VN. Should I file for fiancee-visa or should I go back there to marry her and file for spousal visa?
    Which visa is more popular now? and why?

    Well for one where do u live? Some service centers are faster than others. I would still go for the fiance visa....although it is a little backed up at the California Service Center it still probably isn't any longer of a process then the spousal visa....so i've heard. Also, how did the two of you meet?
    Fiance visas are pretty straightforward and as long as there's nothing suspicious going on and your honest all the way through it is pretty easy to be approved.
    Have you checked the processing dates on both visas? go to www.uscis.gov and you can find the processing times. Also there you can find out which service center you would be going through.
    I may be a little biased because I currently have a k1 visa processing....but i say go for the fiance visa.
    But whatever you decide good luck!!

      I'm in San Jose of California too....and my girl friend is in VietNam.

        from what i see...the k3s are not processing any faster than the k1s....
        I don't know as much about the k3s but from what i've read it is a little more of a confusing process. More forms to submit and more stuff to get approved. Plus you have to get married and then be separated....i think it would be nicer to be able to stay together once the marriage takes place...which the k1 will allow you to do.
        Really though this is just my opinion from everything i've seen and read....

          processing time for K1/K2 is at March O6 2006
          for spouse is at Jan 16 2006

          I have been dating w/ her for 2 years, and met her once last June. I'm planning to come back again soon within this year.
          I know 2 guys are going for spouse visa. They keep telling me to go for that too because K1 is getting slower now.

            look at the processing dates....the spouse visa is almost 2 months behind the fiance visa...that should tell you right there

              I agree with bella. I am currently in the K-1 visa process also through the Cali service center, and from my experience the K-1 is still faster and easier than any of the spouse visas.

              The processing time has slowed a bit lately, but that was due to a change in the filing process that had to be implemented on-the-fly by the USCIS. That is fixed now and they are trying to get back on track.

              Either way, evidence is going to be your main hurdle. When you visit her, be sure to get pictures of the two of you together, save your emails, etc.

              The thing you absolutely SHOULD NOT do, is have her travel to the US on a tourist visa and get married in the US. You will have no problem getting married, but when you try to file for a green card you will be found guilty of visa fraud for purposefully marrying on a tourist visa. This is a mistake made by many people! Just be patient, and stick with the K-1/K-3 process in it's entirety.

                Another k-1 vs k-3 question

                I've read and read and recieved a lot of opinions about it but I'm still confused on what to do. My boyfriend and I currently live in Mexico together. Where we get married on paper isn't important to us but we would like to move to the US as soon as possible and be separated as little as possible. He has a tourist visa now - will he be able to go with me to the US while the visa is processing? Which is faster and with less restrictions. Can anyone sell me on one or the other?

                  OK, the fiance visa is usually faster. I don't know as much about the spousal visa but I know that the fiance visa's approval rate is very high. I know he will not be able to stay in the U.S. while the fiance visa is processing. I'm almost sure the same goes for the spousal visa....you would have to get married and then he would have to return to mexico while processing. I think the fiance visa is definitely safer also. People can run into problems with the spousal visa because you are NOT supposed to enter the U.S. with the intent to marry.

                    K-1 vs K-3 visa

                    I live in Illinois and sent my K-1, "I-129F" papers to Nebraska, where the USCIS told me to send them. They received them on July18th. Nebraska doesn't process I-129F forms. They send them to California now. I checked with the California USCIS and on July 21st, they were processing I-129F's dated March 5th. I checked again today, August 16th, and they are now processing March 6th I-129F papers, (2 days in almost 1 month???). I don't see where I-129F's are any faster. It appears they are now the slowest.

                        Fiance vs. spouse visa

                        I agree with the others on there: Fiance visa is the way to go. Once my fiance and I decided to get married, I asked 4 different visa attornys about the differences and their recommendations. (and yes I did hire one of them.) I was told by every one, DO NOT get married. Wait for the fiance visa. As stated by others, the spouse visa seems to be more difficult because you have more to prove. Depending on which center you use the wait for initial approval is 2-4 months, and then whatever the wait time is for the consulate interview. I have also watched a cousin go through 3 years of fights and denials with the US consulate in Casablanca over a spouse visa. One would think a spouse visa would be easier since you are already married. But like others have said, it definitely is NOT. Our application is in process and pending a mid-October approval.

                          I have a petition on file and my girlfriend (Germany) was just denied a visa to come and visit me. We wanted to be together longer than the visa waiver allows. The officer at the consulate told her she was not elligable for a non-immigrant visa since she is intending to emmigrate soon. I am not sure this was a just decision, they do make mistakes. I may consult an immigration lawyer on this one.

                            Sorry to hear. It's so frustrating at times.

                            What if she wants to visit me within the visa waiver period? Should she be allowed then?

                              What happened?

                              On August 25th, the California service center is now doing the I-129Fs dated February 23rd!!! Previously they were doing I-129Fs dated March 5th and March 6th. Why are they going backwards on their dates of processiing? How can they be keeping up with all of the forms they receive?
