Hi i applied for a K-1 visa for my fiance, he successfully came here and we got married right away. Then in due time he received his conditional resident card (green card). And a month later he left me without any warning. I came home and found a note from him. He took $5K in cash, transported his car all the way to the west coast, left me with $4K and a mortgage on a condo which we had jointly purchased a week before. He is giving me all kinds of excuses as to why we cant live together anymore. Its been 4 months to the day and he has now even stopped calling. I've been patient and loving and still willing to get back with him and work out any issues, but he has shown absolutely no interest in any kind of resolution. He says he is happy where he is, and that I should carry on with my life. I would like to know if his visa can be cancelled and can he be sent back to his country. or is he free to stay here until the temp visa expires. can he apply for a diff kind of visa thru his employer (O-1 or H-1). He is a specialized in his field. Pls. respond as to anything I can do to get him deported since he basically used me to get here. Thanks!

I understand your pain and I am not in your life and so know all the facts but because he left you right after getting his Green Card does not necessarily ,mean that his only intent was to get a green card. Marriages go bad all the time, even when there is no Green Card involved. Try and be objective and separate your anger and let your actions be guided not by spite or revenge that he left you but that you really genuinely believe that he perpetuated a fraud. Your heart and finances will heal and the pain will pass. ..It really will.........
Now having said that, if you remain convinced that his intentions were not pure, you can write to USCIS and say that it was a fraudulent marriage, done only to obtain a green card. Also you both have to sign the I-751 (petition to remove the conditions of residence) >He could actually divorce you though and apply on his own so if he files divorce papers you would have to contest it so as to ensure that he is not divorced before he files.............if you're lucky they will call both of you for an interview. However don't be impulsive..........Its a serious move with serious consequences. Consider the implications if you write the letter and then for some reason you decide to take him back. If USCIS decides that it was a sham marriage, he will never be able to live here or even visit........he will be permannetly barred.

i know how you feel
I know how you must feel, because my other half seems to have done the same......however if he actually stayed with you and got the green card at least he didnt just get married and expect you to lie for him to get the green card...but just because you are upset and hurt, you have to remember that a good faith marriage had to have been proven other wise the green card would not have been granted....and if he in fact did defraud you and the govt, then it will all come back to him some day.....because we always reap what we sow, and life seems to have a way of making some one who does these things pay....
I on the other hand haven't been married long enough for him to have his green card, just waiting on the interview, but with us living apart I do not see how in the world he will get to stay in the usa, so there will be no working it out for us, even if he changes his mind....because it is my understanding once he is deported he will not be allowed to even come for a visit.......and I am hopelessly heart broken by it all, and will always wonder what would have been had we actually had a working marriage even if it was just for the time needed to prove it to immigration......
