    Hello, I need some helpful information for my boyfreind and I. He came from Mexico when he was little and has lived in the US almost all this life. We have been together for 2 years now...but recently his mother became very ill and he went down to Mexico to be with her. We have been trying to attempt a Fiance Visa. I spoke a Immigration Lawyer and got all the forms filled out to begin the process...but the lawyer informed me that since he was living in the US illegally for so long that they would deny our request. It was not his choice to come here when he was so young and that shouldn't be a reason to deny our Fiance request. Is there anything that can be done for us? Can I go to Mexico and marry him? Will he ever be able to come back into the US?

    It might not have been his choice to come but after becoming an adult, it was his choice to stay. Yes, you could marry him and file .

      Though he has acquired illegal stay in the US for more than a year he is inadmissible for 10 years in the US. you may get married in Mexico to him. Consult a good lawyer this time.
