Hi guys,
I really hope someone can help me with my situation. I was currently living in America with my wife. I went there on a tourist visa and applied for adjustment of status. We applied for a spouse visa. Everything was fine and the visa was under process..I had done my medical and also had the interview scheduled for October 20. Just before the interview my mom fell really sick and I had to come home. I applied for Parol to Leave America and they rejected it. I really had to come home because my mom was sick and there was no one to take care of her. Once it was rejected I flew to my home country anyway.

So now my question is will I be able to transfer whatever that was done In America to the US embassy in my country and continue the process. Or will I have to start the whole process all over again.

Well if you did not request a new interview date, and didnt show up on October 20, even with advance parole, your application would have been denied. So you will have to start over again.
If you can afford to, let your spouse here use an attorney.

Thank you for your reply. We do have an attorney in US. My interview has been rescheduled for Dec 10 in Phoenix. Im already in my home country in Malaysia. Do you think I can do the interview here at the US embassy. I applied for advance parole to leave US but the denied it. So I left anyway . Will that be a problem.

What does your attorney say? he would be the best person to answer these questions................
Once you come back in, and they could allow you to come back in, it will show that you did leave and so abandoned your 1-485 application. As to whetehr or not you can preserve the I-130 and interview at the embassy, is a question for your attorney. But i know for sure you wont be interviewed on Dec 10 at the US Embassy in Malaysia. But speak to your attorney and see if the I-130 can be presereve and your case transferred to consualr processing. It will adda few months for sure , if it can be done...but he sthe best person to advis eyou.

BTW Youre actually the first person I know though that got a denial for AP.
