    Hi, I will appreciate any help and am extremely worried.

    Let me start by saying that I am confused about the process I am going through, not sure if fiancee visa applies since we are married. I don't even know what type of visa, green card I am in the process of applying for. So I will explain my situation in the hopes that someone can point me in the right direction, and answer a few questions.

    My wife entered the country illegaly in May 2003, I met her about a month later and we were married in the U.S. on Oct. 24, 2003. We pretty much assumed that since we were married her status here became legal, while knowing that there undoubtedly would be paperwork we would have to do to make it official. So, in April of 2005 we had an appointment to start the paperwork, and found out that she was illegal and basically breaking the law. After receiving advice from the gentleman who helped prepare the paperwork, we decided it was best for her to go back to Mexico voluntarily. She went back April 10, 2005, and I mailed in the first set of paperwork on April 15, 2005. We have a daughter that was born in Mexico on November 15, 2006, I have already done all of her paperwork, and she is an official U.S. citizen with passport and all. I lost my job at about the same time, and was on a healthy severance package until the end of January. About two weeks ago I rec. the paperwork saying that our appointment will be on May 30, 2007 In Juarez.

    So, here are my questions

    1. What do I expect? Any advice?
    2. We don't really have any paperwork in both of our names, I couldn't get a bank account with her name on it due to the fact that she could not go to the bank. Same with the car, no reason for insurance since she doesn't drive and isn't in the U.S., we have been renting in Mexico, but the light and water bills are under the name of the landlord, who doesn't give us receipts.
    3. I have been vigorously looking for a job, but unable to find much that pays well enough, my severance ran out at the end of Jan, I held off, but had to apply for unemployment in the middle of March. How will this affect me? Do I run and get any $5.50 an hour job? can my parents co-sign this late in the process? I will be living in the their house, albeit in a divided apartment (duplex). Are the pay stubs and the job letter required? Or will may past Tax forms be enough?
    4. What kind of Visa, green card does it sound like we are going for?

    hola. suena un poco complicado tu caso. pero, si tu eres un ciudadano americano, tu puedes encontrar ayuda profeccional y gratuita donde un congresista( senador) o en la unidad de servicios al los ciudadanos americanos en mexico ya que ella esta alla'. tambien tengo entendido que ella no tenia que salir del pais, solo tenia que pagar la multa por haber entrado al pais ilegal y luego esperar el proceso aqui en usa. por medio del congresista le podia conseguir el permiso de quedarse y de trabajar hasta que te saliera la cita. es un proceso de 6 meses a un año. aveces un poco mas dependiendo de donde lo envies. dicen que en chicago es mas rapido el proceso.
    y por favor. si en algo tu crees que te han maltratado o descriminado. no dejes de informarlo o reportarlo a la unidad de servicios a los ciudadanos americanos en mexico. ellos pueden determinar si en algo te han violado tus derechos. al mismo tiempo, haciendo eso podemos minimizar los abusos que se nos aplican a nosotros los immigrantes.

      Uh...

      It seems she will receive a IR1 visa (green card). You must to have the copies of papers that you sent and received to/from USCIS, affidavit of suport I-864 is necessary. You can try to find what is the kind of visa in the letter that you received from consulate.

      One of these papers you must have:
      1. Documentation showing joint ownership or property; or
      2. A lease showing joint tenancy of a common residence; or
      3. Documentation showing co-mingling of financialresources; or
      4. Birth certificate(s) of child(ren) born to you, thepetitioner, and your spouse together; or
      5. Affidavits sworn to or affirmed by third parties havingpersonal knowledge of the bona fides of the maritalrelationship (Each affidavit must contain the full nameand address, date and place of birth of the person makingthe affidavit, his or her relationship to the petitioner ofbeneficiary, if any, and complete information and detailsexplaining how the person acquired his or herknowledge of your marriage); or
      6. Any other relevant documentation to establish that thereis an ongoing marital union.
