  • I have a B1 but I have a child and she hasn't what can I do?

    My boyfriend is from Puerto Rico so we want to get married but I have a child from other men so I have a B1 visa I can go there and get married but my baby hasn't she is only 16 months and one time they denied the visa so now i need to go there, what advice can u give me ???

    Your boyfriend neeeds to become an US Citizen. And sponsor you for a K-1 visa (including your child as a K-2 dependant)

        He needs to apply for a K-1 visa for your (once you are officially engaged).

            Grammatical issue. Being "From" a place sometimes is not the same as being "Born" in a place. Or being a Citizen of such place. Where have you been?

                Both of you are right from your viewpoint. As we don’t know her boy friend born there or not but As per INA: ACT 302 - PERSONS BORN IN PUERTO RICO

                Sec. 302. [8 U.S.C. 1402] All persons born in Puerto Rico on or after April 11, 1899, and prior to January 13, 1941, subject to the jurisdiction of the United States, residing on January 13, 1941, in Puerto Rico or other territory over which the United States exercises rights of sovereignty and not citizens of the United States under any other Act, are hereby declared to be citizens of the United States as of January 13, 1941. All persons born in Puerto Rico on or after January 13, 1941, and subject to the jurisdiction of the United States, are citizens of the United States at birth.
