Employment through KI Visa

Hi All,
It seems that the K1 Visa can only be used for employment following application for an EAD. Can I apply for the 1-94 with work authorisation?

you can ask the BCP officer at the POE.

Whats the BCP Officer? And by POE do you mean Point of Entry in which case, can I only request this when I arrive? Is it possible to apply for work authorisation as part of the overall fiance visa?

Border and Customs Patrol = BCP, the officer your meet at the port of entry.

You can file for EAD based on your K1 when you arrive to the USA also.

Is it possible to apply for it before I arrive in the USA ie as part of the application in my home country or so that EAD would be granted simultaneously with my KI - Visa, so that I would be able to work as soon as I arrived in the US.

No.

But also, are you coming to the USA to get married or to work? You can not demand much from the system, the visa is MAINLY for you to come and get married, everything else falls in a second priority.

What is the time frame between arrival and getting married? Can this be done straight away? Following the marriage how long should it take before I would be able to work legally in the US

You have 90 days to get married and file for AOS. If you get married during the first week, and file the next week, you could have your work permit in 8-12 weeks after your arrival.

Is it essential to remain in the US for this period? Or could I return to the UK and work to come back to the US following the authorisation of the work permit?

You can not leave the USA after you filed out and submited the application. Otherwise it will considered abandoned. Plus your K1 visa is a single entry visa (you can only use it one time to enter).

You would have to apply for a travel permit (i131) which would allow you to return to the US. But you must submit this with the rest of the AOS application and it would take about 60-90 days for it to be approved and sent to you.

Also, you'll need to appear for fingerprints and your AOS interview (at 2 separate dates) in the USA, so you would make at least 2 trips back and forth the US and UK?
