  • Question about Part C of the I-129F form

    I am the US citizen in my case with trying to get my fiance' here from Moldova. I am confused about the question in Part C of the I-129F petition. It asks me, the US citzen, if I was CONVICTED of any of the following crimes in the questionaire. It does not ask if I was arrested for any of these crimes. In my case I was arrested for things, but the charges were dropped and the record reads "Nolle Prosse", which means that the charges were dropped. I was never convicted, or had to serve time, or pay a fine etc. for those charges. I had a DUI charge in 1993 that was a conviction, but it was only one time, and the question says 3 times for any such charge needs to be reported.
    Do I have to report any of the things if I was not convicted? It will show on my record that they were dropped. Is it nessessary for me to gather all this information being that I am the American citizen trying to get my fiance' here with the K1 VISA? Can I just answer NO to the question, and will they accept it, even though something does show up that was dropped?
    PLEASE HELP!

    Why was your fiance' denied? I have already told my fiance' of all the things that has happened in my past with other relationships. She knows all about my arrests also. I was never convicted of any crimes, only arrested and charged with crimes, but never convicted. The only thing I was convicted of was the DUI I had back in 1993, to which they ask to reveal only if I had 3 or more of cries relating to alchol or drugs. I hear I shoud be fine.
    What can you do in your situation? I hear that the consulate has no right to deny the petition that was approved by the US. It can only suggest that it not be approved, and they have to have good reason to convince the US Immigration that a denial should be nessessary. My fiance' and I really love each other, and I don't think I can handle them denying us us from being together! I don't know how you can deal with it, I would go ballistic!

      Yes, I was charged, but never convicted, the charges were dropped. I even went to try to get my record, and it shows that I was arrested, but it shows no charges, and it reads "Nolle Prosse", which means the charges were dismissed.
      You sound awfully negitive, and it is hard to believe you are being honest even here with your answers. I think I can see why you were denied, if that is even true. It seems you didn't fill everything out correctly if that is the case.
      You never mentioned the rest of the story of what happened with your fiance'?
