Hi,
I have been looking on website trying to find out which visa and where to submit it for my husband. I am an US citizen and he is Australian citizen and we got married in the US in April but moved to Australia and went through the process of me getting temp residency. Now things have changed and I am going back to the US in two weeks with him hopefully able to come a couple weeks later. I am not sure what visa to go for and how to go about it.
I know I need to send in the I-130 form when I get home...then what...does he go for a K3 visa? Does he need to do it from the US since that is where we got married? I am confused and cannot find anyone to help me even at the US consulate here in Australia...they say I have to do it all through email to get answers and it could take up to 10 days. It was soo much easier to go through the process here to become Aust resident.
I guess my 2 questions are...
1. Is it the K3 visa he should apply for?
2. Does he need to be in the US to apply since that is where we were married even though we have been living in Australia since May 2008??
Any help would be sooo much appreciated...this is confusing.
