I have a pending I-195F petition, and I know that the official story is that such petitions can almost never be rushed, except in emergency situations. Now I do not think my case is a life or death emergency, but we are expecting a child together, and it would obviously be easiest if everything could be approved before the baby is born. My question is whether the pregnancy would qualify under any of the categories for expedited processing. If anyone has any experience with applying for this type of thing, I would really appreciate your input.
If not, things should hopefully work out, because the father is eligible to enter the US on a visa waiver to be here for the birth if things are not ready in time. However, we are a young couple just starting out, and flying back and forth an extra time is just one more expense on top of everything needed for the immigration process. In addition, I am concerned that if there are any complications or the baby is born early, I will be alone without my partner and the baby's father. And even if he is able to come for the birth, there is reason to believe the baby may need special care after birth, and I do not want him to have to leave while our baby is still in the hospital.
I have tried several times to call the service line, but this has gotten me no where. All I ever get is someone obviously reading a script, and usually in an accent I am not used to, and when I ask specific questions I am told they may not legally give me any assistance. When I tried ask if I was potentially eligible for expedited processing, I was told no one could tell me; I could either apply for it or not, but they could not give me any advice. When I said I would apply, the man started rattling off a whole long list of potential categories I had to pick from. I had a hard time understanding the information due to his accent and the unnatural speed it was read. I asked if I could please receive some information in writing or online explaining the options, and was told this was not possible. Despite the fact that he was obviously able to pull up the information about my case on his computer, I had to supply everything (including the dates THEY received my information) and it took a long time to get the spellings right. Eventually I just gave up on applying, because I did not have that much time during working hours to go through all these questions. I plan to call back, but want to make sure I know the appropriate category to apply under, so they do not deny it unnecessarily. I am considering hiring a lawyer, but I can hardly afford the fees (yet make slightly too much for the free assistance), and do not want to pay $200 just to ask a quick question.
