    Hello all,

    so this lawyer (or his assistant) who made all those stupid mistakes on out I 130 petition has now sent the forms off to CHICAGO???? As far as I can tell, it's a field office and they don't even process I 130s or 129s. Is there something I don't know??

    I am from North Carolina, and I was pretty sure it was supposed to go to Vermont. The lawyer is in Oklahoma where my mother in law is, but if you're from OK then it goes to California, so either way, Chicago seems like the wrong place all around.

    What is going on here?! This lawyer supposedly has some awesome sucess rate but there have been so many mistakes I just don't know what to think.

    Nevermind, apparently that's the way it was supposed to be... I just don't know why, and I was always told differently.

    I really wish I were better informed... I just can't find info about why Chicago... mother in law explained that it's some sort of distribution thing?

      Adjustment of status petitions go to the Chicago Lock Box, also known as the National Benefits Center. People who are already in the US (like on another visa) file the I-130 along with the Adjustment of Status petition there. Or K visa holders who have entered the US apply for adjustment of status there.

      K1 or K3 petition start at either the Vermont or California Service Center.

        Well I guess that means that the lawyer screwed up yet again. Neither of us are currently in the US.

        Could the fact that my husband had a previous I 130 petition filed by his Mom mean that it would get sent to Chicago??

        I'm just trying to find ONE reason that makes sense

          If you live in OK your petition would go to Vermont (K1,K2,K3)....

            It is hard to answer your question because you didn't give enough background information. Who is the US citizen? Why are you both living in another country? Are you both residents of that country. Can you qualify for direct consular filing? If you read the instuctions and application forms for the I-130 it will tell you exactly where to mail them. Get the latest version of forms directly from the USCIS website.

            The lawyer sounds worthless. Perhaps he isn't up on the latest changes. The service centers for initial filing of K-3 petitions were cut down to only Vermont and California perhaps just a year ago. I don't remember when the change was made, but I'm thinking it was summer or fall of 2007.

            A mother filing for a son is a totally different process with different filing procedures and probably different locations and certainly takes years. I don't know enough about that process to comment.

            Have you read under the VISA tab on this website to learn about the different processes.

              Trust me everyone, I've done my research- read all of the info on this website and any other website I could find. The lawyer is based in Oklahoma, where my husband's mother is, but my house is in North Carolina, which would mean that it would go to Vermont. I am the US citizen. Why are we both in another country? Well, obviously because we want to stay together during the process. God only knows how long it could take.

              We are not eligable for DCF because I havent been a resident of Venezuela long enough. 6 month minimum, my residency won't even begin until January or so.

              This is what the lawyer told me via email:

              "An I-130 with I-485 attached is sent to a service center, however, stand alone I-130s (when the beneficiary is outside the US) are file at the National Benefits Center in Missouri. That office is located in Missouri but the mailing address is a PO Box in Chicago. "

              At this point I can't do anything but cross my fingers and hope that he knows what he's talking about.

                Every form filed tells exactly where to mail it in the instructions. The instructions for the I-130 are a separate document from the petition.
