  • Cdn Wants to Marry & Already in the USA on a TN

I am currenlty working in the USA on a TN visa. I have met an American citizen and we would like to marry. Is there a way to go through the Fiance Visa-marriage process without leaving the USA during that time so I can continue working? Also, how do I continue working in the states when I assume I would have to switch from a TN visa to an EAD? Curious to know how this may affect my professional career before we start down this road! Thanks for any insight.

People already in the US on another visa marry first, then file I-130, I-485, and I-765 ?? (the EAD form) together. You would be in a category that a visa is immediately available to you because you are married to a USC.

Do it before the other visa expires. It has rules and such so research it elsewhere. I don't really know that route, and I can't find it covered on this website. You can work as long as the other visa is valid. If it expires while you are awaiting a decision on your green card, then you are generally ok to remain in the US while you await the decision but should quit work between the expiration of the work visa and the time you receive EAD.

EAD only takes 60-90 days if you file a proper set of Adjustment of Status documents and they don't have to request more evidence. The whole green card process is taking around 5 months right now for the people I keep up with.

Please research this further. I'm not certain of this route so don't follow what I said as anything more than a general description. Perhaps the actual instructions for the I-485 would give some good information.
