  • Questions about "evidence."

I'm just starting the process to bring my fiance from the Netherlands and have a couple question:

    1) As to evidence we have met in the last two years, how much should I send? The most concrete thing I have is a rental car contract with me as the renter and her as the additional driver. I have dozens and dozens of undated pictures, both in the U.S. and over there, but I'm not sure if these will be of use. We also have boarding passes that show we have traveled back and forth, but they don't necessarily prove we have met. Or is that, in combination with photos, enough? Proving this is harder than I thought.

    2) As to evidence of mutual intent: I guess a receipt for a ring would be most helpful, but we're spending so much in airfare trying to see one another that a ring is out of the question right now. Any other suggestions? Also, what should the "original statements" include other than "I want to marry this person?"

    3) I've seen posts in this forum about an affidavit of support, but there is no mention of it in the I-129F instructions. Is this required?

    Thanks so much!!

Hi there Jbiel, and welcome to the forums

    1) I sent in boarding passes, and pictures of us together, along with photcopies of my passport entry stamped pages. I also sent copies of written letters we had sent each other, along with an actual photo of us on webcam together stating this is our main source of keeping in touch when not physically together.
The rental car statement is also a source of information, simply send anything you have that "you" consider evidence, you won't get penalised for sending more than is neccasary. Don't worry about the pictures being undated.

    2) I was also in the same situation and only recently just purchsed my fiance's engagement ring, I didn't sent a receipt for it obv bcos at the time I didn't purchase it, I wouldn't worry about that. Nowhere in any US law does state that two persons wishing to be married must signify it with an engagement ring.

    3) The Affidavit of support is evidence that your fiance earns enough to make sure you wont become subject to public charge, and that he/she earns above the 125% of the poverty line. Yes It should be included in the application, but becomes more apparent at the actual embassy interview which your fiance will attend at the US embassy in his/her country after the application is approved

More information available here : https://www.immihelp.com/usa-visas/k...n-process.html

Good luck ! and Congratulations on your engagement

      Follow-up question..

As for the affidavit of support, it is my understanding that I don't send this in with my petition, but my fiance would have to take it to her interview at the consulate. Is this correct?

        To clarify my follow-up

Sorry, Woodger, to clarify my follow-up; I read your post in which you said that I should include it with my petition, I'm just not seeing that anywhere in the instructions on the site or the forms. If it is in fact required, it just makes me wonder what else I may be missing that isn't explicitly listed.

Also, there seems to be some confusion as to whether the I-864 or I-134 is the right document. Any insight there?

BTW, thanks so much for your responses and your time. Congratulations to you as well!

You need to send the affidavit of support to your fiancee to present during the interview. What is required at the VISA interview gets a little tricky because each embassy can set their own rules. I think they get to set their own rules based on how truthful people from that country has been ( I know the tourist VISA waiver program is based on truthfulness).

After you get your petition filed check with the embassy's website and find out what is needed for the interview from them. Our embassy stated that the I-134 would not be sufficient and to use the I-864.
My Fiancee arrived here on a K-1 VISA.
          Conditional GreenCard has been received.
