  • Packet 3

I'm looking ahead to next steps and what I can do to help my fiance prepare and I ran across some questions about the documents from Packet 3.

First, I've seen conflicting information in different places. Some people have said to send in JUST the checklist for Packet 3, but then I've seen instructions in actual forms that I've found online that say to mail in the documents themselves - originals and copies - prior to the interview. In the Visa Journey interview reviews, most people say they have to have their documents at the interview, so if you have to mail them in, how will you have them at the interview??? Which is correct??

Second, the form instructions I found also said you have to have the original Affidavit of Support as well, and that the signatures have to be less than six months old. I submitted my Affidavits of Support with my I-294F (my mother is giving a secondary one so I can prove he'll be well supported, even though I make enough to support him, since I heard finances are the number one reason for denial). If I submitted them with my I-294F, how will I have them to send to him for the Packet 3/Interview process? Will I just need to make new ones? Were they required for the I-294F, or just his portion of it? Was my attorney an idiot again?

Thanks in advance for your help.

I'm guessing you mean the I-129F Fiance petition?

Support does not come into consideration with that petition to USCIS. You're lawyer isn't very knowledgeable. The petition is just to see if you two are eligible to apply for a fiance visa. The visa itself comes from the Department of State via the Embassy. That where you have to prove support of the intending immigrant. Fill out another one for the visa application at the Embassy/Interview.

About the documents--each Embassy has their own procedures for collecting documents, scheduling interviews, etc. You will receive instructions, hopefully from your Embassy telling how to proceed and what to mail and what to bring. That's what you should follow. You didn't say the Embassy, so anybody with knowlege of that Embassy could reply with specifics.

Yes, I meant the I-129F Fiance Petition.

I'm not sure if the attorney isn't very knowledgable, or if she just wanted me to turn in ALL of my paperwork before we started the process and kept that back for the packet 3 documentation. She told me we'd assemble all of the packet 3 information I needed to send and send it to him at once as soon as we get the NOA2, that way he'd have everything he needs all in a nice, neat little package and a list of everything he needs to add to it to keep things simple for him.

I've emailed my attorney to ask if this is the case (I'm hoping so, if not I'm going to get really upset, because it took my mom half of forever to get her personnel letter from the University where she teaches, and if I have to tell her we need a new one and a new form she's going to get testy.) I know I make enough to support him on my own, but last year I only made $19k according to my tax return, because I didn't work for part of the year, so my mother has offered to help me fill the gap JUST IN CASE. Can't be top careful in this process, it seems.

I'm also wondering, why is it called Packet 3?? I get that the I-294F petition package itself would be Packet 1, but is there a Packet 2 I'm missing somewhere?

Sorry, I'm still new to all of this.
