    I know someone who came an the K1 visa and now his wife abused his and call the poilce on him and put him out of the house. what rights does he have when something like this happen?

    can he still get his permanant green card?

    He can only get a green card if they have filed AOS and she has to fill in I-864 affadavit of support.

      Permanant Green Card

      His Conditional GC will expire August 20, 2011. He and his wife need to file I-751 to remove the conditions. He cannot file it on his own because he never reported the abuse to anyone because he didn't want her to get in trouble.

        awful Permanent Residents who got married before obtaining a Green Card are not required to file an Immigrant Petition on behalf of their spouse (or any children born before becoming a Lawful Permanent Resident). A spouse and eligible children of a Lawful Permanent Resident in this category may apply for a Green Card without having an approved Immigrant Petition. This process is known as "accompanying" or "follow to join." Lawful Permanent Residents who have "adjusted" to Lawful Permanent Resident status in the U.S. must file Form I-824, Application for Action on an Approved Application or Petition in order to notify the appropriate consulate that their spouse will "accompany" or "follow to join.
