Hi All,
Please advise me at the earliest.
I got my H1-B Visa on 2010 and started working from July 2010. (It was a cap-exempt visa) I was working till Nov 2011 and then I took maternity leave and was paid EDD till first week of March 2012. After my delivery I had some medical issues and was under medical treatment and physiotherapy. I have Medical certificate till June 2012. After June I was trying to return to work but I haven't got job till now. My employer haven't run payroll after Nov 2011. I understand I am out of status now.
I have to go to India on Dec 2012. So my doubts are,
1) Should I apply for H4 visa now when I am in US?
2) Can I travel to India before H4 is approved ?
3) What is the chance of H4 getting rejected ?
4) When I go for stamping in India, Will there be any issues?
5) After coming back from India, I am planning to take H1-B visa and work. Will there be any issues then?
Please clarify my doubts.
