  • Need Help: H1B to Greencard (timing)

    My second term H1B ends October 2006 and I (and my employer) want to start the Greencard process.

    I have heard that:
    1. I have to start the Greencard process 1 year before the end of the second H1B term?;
    2. That the term starts at the first entry under the first term of H1B, not at the issue date?
    3. that it is possible to get an extension for 1 more year under H1B?

    Could anybody confirm or deny the above or provide extra advice?

    Pursuant to AC 21 American Competiveness in the Workplace Act of the 21st Century you can get 1 year extensions of your H1-B if you have a labor certification that has been pending for at least 365 days.
