  • New h1b: Any restrictions on the employer filing petition?

    Hi, I am currently on H4 visa. My previous employer (in India) is willing to sponsor new H1B in April '13. This is a startup in USA with development center in India. It has around 15-20 employees in India and 5-6 employees in USA. Company location in USA is San Diego and I live in bay area, so I would like to work from bay Area, visiting SD office sometimes. My query is - is it feasible for this employer to file h1b for me in coming April? Are there any restrictions on the employer? (like headcount, turnover, etc) Secondly if H1b can be done, will I be able to work from other city? What are the chances that such case gets approved by USCIS?
    Looking forward to some info in this regard. I am new to USA and not sure if I should wait until April '13 or search for other more reliable options well in advance.

    As long as the job is genuine and they can pay you the prevailing wages, smaller employer is not a problem. Working in a different city is not a problem.
