  • H1B transfer - RFC status

    Hi I transfered my H1 visa to B company , after i received the receipt notice i resigned from company A and started working with company B.

    now , my visa status went to RFC (request for Evidence)....

    1. So, can i work with company B ? with my visa status as RFC ?


    Can you please reply .. very urgent..

    Yes.
    That's why its always advisable to join only after transfer. Keep hoping you don't get a denial. If you do, you are out of status.

      It's been a month, since I have come to US with H1B.
      My employer is not able to find me a project, so he did not start my payroll.
      Do I have an option to transfer my h1 to some other employer?
      What will happen if the transfer is denied?

        Irrespective whether the employer has work for you or not they should be paying you as per LCA. If not, you are out of status. You have two options, either leave US and re enter as and when work is there OR complain to DOL and find another employer willing to file a cap exempt petition on your behalf. A transfer to another employer may not work without an underlying complain to the DOL.
