H1B Extension Question

I was on H1B from Oct 2008 to July 2009 ....I changed to F1 status in July 2009. .
I was in F1 status from July 2009 to Apr 2010.
I changed to H1B in Apr 2010 . Got a three years H1B until march 2013.

I need to extend my H1B in March 2013. My company Attorney says my H1B can be extended only until mid Dec 2014 including 80 recapture days since i started my HqB in Oct 2008.

I was assuming that H1B is for 6 years and i have used from Oct 2008 to July 2008 - 10 months and Apr 2010 to Marc 2013 whcih is 3 years. So i am eligible for 2 years and 2 months and 80 recapture days which would make it until August 2015.

You can be on H1 for 6 years.

And you can recapture the time you were outside the U.S.
