  • God laid off. How difficult will it be to convert back to H1B from F2 visa?

Got laid off recently due to corporate downsizing, but will be on payroll till the 31st of December 2012. How can I be on H1B status after that (till I find a job) ? My husband is on F1 visa. Should I convert to F2 Visa right now? I have approved H1B visa for 3 years. How difficult will it be to convert back to H1B visa from F2 visa ? Please help.

If you want to stay in the US, you must apply for change of status before last day at work. Otherwise, your employer must pay for a ticket to home country.

If you find another job, they will be able to petition for you and you can work for them after approval. There may be complications if change of status to F2 is pending at that time.
This is my opinion and not legal advice.
