  • H1-B petition expiry is 6 months ahead of 6 year duration

    Hi,
I came to US on Dec 2007 in L1 visa. I changed to H1-B on Aug 2010. My I-797 shows approval notice till Jun 2013 and my current I-94 also expires on Jun 2013.
As per my knowledge, in H1-B I can stay in US for 6 years.

So how can I extend my I-94 to Dec 2013?
I have around 4 months to re-capture, can I do both together?

Note: Consider the situation as my GC is not started by current employer.

Expecting some expert advice as always.
    Thx
    Rakesh

Count the number of days that you have spent in the US in L1+H1 status. That should not exceed 6 years.
This is my opinion and not legal advice.

      Hi,
Thank you for the reply. I know it's the total of L1+H1.
My question is how can I request for extending it to 6 years + re-capture if my GC is not initiated yet.

      Thanks
      Rakesh

Your employer just needs to file a petition as usual, nothing different.
This is my opinion and not legal advice.
