  • H1-B visa stamping - Original I-797 lost

    Dear All,

H1B petition filed by an employer for me was approved. Unfortunatily, the employer sent supporting documents including original I-797 via some unreliable postal service and it seems parcel is lost or would go back to sender. After discussing with postal service, i assume it gonna talk much longer to figure out what happend to the parcel.

I have scanned copy of Aproval notice I-797 and other supporting documents like LCA, I-129 etc.My question is: if i get visa appointment and take copy of I-797 and other supporting docs with me in interview, what will happen? Would visa be denid in case if i present copy of I797 to interviewer instead of original upon asked? I read some posts on forum where people were not even asked for I-797.
I am in impression that if applicant is missing any supporting doc asked in interview, he is given time to produce and submit that doc. Is it correct? if yes how much time is granted?
Its already quite late now and i dont want to delay visa stamping any further. If anything required from employer, i can ask for it.

    Regards

    Hi All,

Just to update, I did some research work and found a contradiction.

See below snippets and their sources

"Important Note: The Form I-797 is no longer needed for your interview. However, to verify petition approval we will need your I-129 petition receipt number so please make sure to have this available."

Please bring a copy of your Form I-797, Notice of Action, or your I-129 petition receipt number to the interview."

H, L, and other petition-based visa applicants may bring copies of the I-797, I-129 and other petition-related documents "

However Original I-797 is asked in Dubai consulate where i would go for visa stamping.
