  • H1 Extension: Question abt I797-B Notice

    I am on H1-B visa in US. My employer applied for extension and was approved this month. But instead of sending I-979A notice USCIS send I-797B which does not have I-94 attached. I am told that this is a system issue at USCIS side and my employer is going to file an amendment petition. Does any one faced similar problem and how was it resolved??

    There are multiple reasons why this can happen.
    1. You were not maintaining H1 status at the time petition was filed (as on receipt date). This means your I-94 had expired at that time or you were not getting paid as per LCA or any evidence of this was not correctly submitted to USCIS.
    2. Your employer may have mistakenly not requested extension of status.
    3. It may be a mistake on USCIS's part like your employer suggested.

    In case of 1 or 2 if your I-94 has already expired, you are already accruing illegal presence.
    In case of 3, your employer can ask for a correction and it will not affect your status if USCIS accepts their mistake.

    But, be very involved in this. It affects your legal status in the US. Posting more details here will also help.
