  • H1-B visa extension query

    Hi,

    My I-94 is expiring on June 18, 2013 and my Visa is till Aug1 2013.
    My Company is already in the process of applying for my H1B extension with my present I-94 details.I am planning to visit India on the last week of April.
    But while coming back from India I will receive a new I-94 from the point-of-entry.
    Do I need to update this new I-94 details in my already raised H1B extension after coming back? If by that time my visa gets approved do I need to do an amendment for the new I-94?

    Please suggest.

    This is the reason its not recommended to travel after filing an extension request. Either file extension after return on H1 based on the new I-94 or travel after 01-Aug-2013, get a new H1 stamped and return.

    It just does make sense to file for extension and then travel. Extension is filed for extension of stay /status it doesnt extend your visa validity. If you are leaving the extension request is considered abandoned.
