    Hi,

    I've been working for a Company A, but approached company B to file for H1B.
    I've got H1B stamped with Company B on Dec'12.

    But even today, I'm working with Company A, as Company B says it hasn't been able to find me a client in US.
    Till B doesn't find me a client in US, it says I'll have to be in India.

    Company B also gave me an offer letter (which I accepted) in July'12 stating that I'll be working in US. When I went for Visa Stamping, the documents they provided stated tentative date as early Jan'13 for me to land in US and join their office.

    Co'B also made me sign a bond that if I didn't travel to US, I'll need to pay them some amount.
    - Now since they are not sending me to US, do I still need to pay them?
    - Am I in anyway employee of Company B? Can I ask them to pay me as if I were on bench?

    I've some other companies in US who can file for fresh VISA and I can wait for it till October'13.
    -- Going through some advices, I understand that I'm not eligible for H1B transfer, so if I apply for fresh H1-B VISA, after getting my current H1B cancelled, am I still part of cap count or exempted from it?
