Leaving US after filling H1B petition

Hi, I will be in US by 10th of March 2013 on H4 visa status, i have got a sponsor and i am planning to file H1B petition in April 2013 itself. But i want to come back to India in the last week of May and will return to US by July/Aug. I have some quire's about my petition and COS.

1. If i apply for H1B with out COS (assuming premium processing), can i leave US before my petition got approved OR leaving US before approval will have any problems in getting my petition approved?

2. If my petition got approved when i am in US and i come back to India, then can i return to US with my H4 status and apply for H4 to H1 COS afterwards?

Please suggest me the best way for applying for H1B in my case (travelling to India in between)
