Is it necessary to have a valid i-94 till October 2013 for applying fresh h1B.

I am on a H4 visa which is expiring in June 2013 . I have I - 94 till June 2013 . Our Visa expires in June 2013 . My Husband's Company will be applying for our Visa Renewal in premium processing ( H1B for him and H4 for me ) in March 2013 . Can I apply for a Fresh H1B with change of status with a firm even when I currently do not have a valid I - 94 till October 2013 . I will get renewed I - 94 till May 2013 probably .

Your employer's lawyer will have to carefully prepare this petition. But it is possible.
