L1 To H1

  • L1 To H1

    I am currently on an L1A valid till May 2006 and have filed a fresh H1 petition and not a status change.
    In case i go back to Inida on L1 and return back in say november 2005 , does it affect my H1 ??
    Appreciate if anyone can offer advice or pointers .....

      Yes H1 is approved but i havent started workign for the company since I need to have it stamped .

        Hi,
        You can come and go back on your L1 stamping which is valid till 2006. And you don't need to get the H1b stamping on your passport to work for the H1b company, if u r already in the US. You can legally start working with H1b co. if your petition has been approved. In fact u can start working for H1b Co. even if you have proof that it has been filed (receipt of fees paid, etc). But u should be aware that if your petition does not get approved for some reason, then u will have neither L1a nor H1b. So do the needful.

          I am a bit confused. I thought the L1 to H1 transfer without going out of the country is possible only if i request for a Change of Status, which in my case i havent ... I have applied for a FRESH H1 and requested for counsulate Stamping . So incase my H1 is approved can i still work for H1b company even if my status is still L1a ??

          Also how will H1B denial (incase) affect my legal L1A status ?This is a bigger concern for me now .... pls let me know if u have insight into this.

              You will have to go home for your H1B stamping before you start working for H1B company.
