within cap RFE in unused H1 transfer

I am on my L2 EAD and got my H1 through company A but could not work through H1 B for company A . Transferred the H1 to company B and now we have RFE which states that H1 B transfer is subject to cap ( which is wierd because i got it approved ) through the cap . My attorney said that this is not rule by USCIS but CSC seems to issuing RFE recently for unused H1 B .

Has anyone come across this ? Was your application approved /denied ? ANy suggestions on what to do ?
