New H1 for me, while my husband's H1 Transfer and extension under progress

Please help me out with this...
My husband's H1B Transfer and extension is under Process. The date on our i-94 is 17th Nov 2012.

I am planning to file my H1B this month under April Quota. Will this be a problem...
