H1B COS-LCA can be applied in USA

I am currently on L1 B visa in USA.My spouse will be coming to USA on L2 on May 1st,2013.We are planning to apply H1B COS for my spouse after my spouse comes to us in H1B regular qouta. we do not know whether the H1 B qouta will be available till may 1st.To speed up the process can the consultancy apply for LCA when my spouse is in india and after my spouse comes to usa on may 1st can we apply for H1B?
