last year i'm fired by my old employer. Later on I switch to a B2 status, later approved, and filed a further B2-extension petition, now pending, but kind of unlikely to be proved.
Recently I find a new job. Is it still posibble for the new employer to file a new H-1B petition?
I heard people say that change of status to H-1B is not possible now. The only possible way is consular processing---obtaining the visa at the US consular in my home country.
My question is, is that saying true? If so, is it too late to file the application since I'm out of status (but in a pending status) for so long?
Do I have to leave before the expiration of my I-94?
