  • Lost H4 Original approval notice - Urgent Please Help

    Hello,

I had my H1B stamped from company A which is valid till Sept 2014 and then I moved to a company B, which did my H1B transfer. The latest H1B was approved till Sept 2015 and I received a copy of I-797C and I-797A along with original H4 approval notice, with the revised I-94.

My wife and baby went back to India in November 2012 and I am travelling to India tomorrow to bring them back on April 10, 2013. My question is do I need to produce the original H4 approval notice at the POE or a copy of it would be sufficient? Some how we lost the H4 approval notice and now I am concerned that this should not cause an issue for us to re-enter into US.

Please note that we all have a valid visa stamping which is valid till Sept 2014 and we have the copies of H1B approval notice and H4 approval notices. Please help me to understand what needs to be produced at POE. Thanks for your help.

    Thanks,
    Rama

They only need the H1 approval notice to travel to US. What they had was extension of H4 status approval notice and it becomes irrelevant once they leave the US. Although, you should keep that for future records. Check with your company's lawyer if they have a copy.
This is my opinion and not legal advice.

Thanks Kabkaba. We have a copy of the extension of H4 status approval and as I will be travelling back to US with them and I have a copy of H1B approval (I-797C), we should be good, right?

      Thanks,
      Rama
