Need an urgent help on the current situation/dilemma that we are in. Here is crisp summary of the scenario we are going through.
I entered US last year in Mar on H1B with employer A. My wife who was working with a multinational IT ORGANIZATION in India took the job transfer and came here with me on L1B. Later her assignment with her company got terminated in nov month last year and she had to leave the job and moved to H4 status that was approved in Feb this year. Now, she is going to file her H1B petition through a consulting organization. They will file her visa petition in April month which will get processed by Oct 2013.
In the interim (before Oct 2013), we are planning a trip to our home country India and we need help on the Following given things:
1. Is it advisable to travel to India during her H1B processing? in other words, If we plan to travel in july/aug month, will it have any impact on her visa processing or decision?
2. She has L1b stamped on her passport, if we go to India, Will she be needed to go to US embassy to H4 stamping? And if yes...will it impact her H1B processing?
Would really appreciate your help on this.
