L1 got RFE and H1 is in Processing If L1 denied then can i work till H1 Approved

HI,

I got L1 RFE and USCIS has given time to till June 2013 to respond and my company applying H1 B visa now.

If my L1 B denied then

1. Can I work in USA as my H1 b is in process?
2. If not then what is the other options.

Can you please suggest?

If your I-94 has expired or expiring before 01-Oct-2013 and it is a fresh H1 that is being filed for you then you cannot work if your L1 extension is denied and if denied you have to leave US, get H1 stamped outside US and try to return on H1.
