H1 Visa Renewal

Hi All,

I applied for H1B visa in 2008. I was unable to travel due to recession and the visa got expired in Sep 2011. At the same time it is also containing stamp "Cancelled without prejudice" by visa counsellor while i went for B1 in April 2011.

Please let me know if i can reapply for H1 B and can renew the previous H1B visa. If yes, is it cap exempted ?

Any other valuable advice will be helpful.

If the Visa was not canceled and not expired, you could have used that along with the new petition to travel to US. The 'without prejudice' part ensures that there is no impact on future Visa applications.

Ok. But this cannot be called as H1B renewal correct? It has to be new application right and it will be part of CAP, correct?
