On h4, want to get on previous h1

Hello,

My H1b petition was approved from Oct 2007 till Oct 2010. I used my H1B from Oct 2007 till Oct 2008, after which I changed my status to H4 visa. Now I would like to get back to H1b using my old petition. My questions are,

1) Am I cap exempt for any employer?
2) Even though the H1b quote is already over for this year(2013), can my h1b petition holding employer or any other employer file change of status to H1b even now and can I start working?

Hi ,

Could you please help me.

I am going to apply for H4 visa. May i know if it is mandatory to change my Lastname or family name in my passport.

I just got married and in my old passport my name is Ann C J ,

2 questions for applying for H4 Visa:
@I need to add my spouse name in The field ' name of spouse"
@Do i need to change my name Ann C J to Ann J G ( as G is my husbands family name)
